General Terms and Conditions

1. Scope

1.1 These General Terms and Conditions apply to contracts concluded on or after 11 October 2026 between Escape Room Industry Services UG (haftungsbeschränkt), Waldhausener Str. 31, 41061 Mönchengladbach, Germany (hereinafter "TIMEBREAK"), and its customers concerning the booking and performance of escape rooms and other leisure activities as well as the purchase and redemption of vouchers. Contracts concluded earlier are governed by the terms agreed at the time of conclusion.

1.2 Deviating general terms and conditions of the customer apply only if TIMEBREAK has expressly agreed to them.

1.3 Individual agreements

Individual agreements made between TIMEBREAK and the customer take precedence over these General Terms and Conditions.

Unilaterally submitted orders, purchasing conditions or other deviating contractual terms of the customer do not become part of the contract merely by being sent. A corresponding agreement between the contracting parties is required.

2. Offers, booking and conclusion of contract

2.1 Booking options

Escape rooms and other TIMEBREAK offers can be booked via our website www.timebreak-mg.de or by individual arrangement. Vouchers can be purchased via our online shop or on site.

Only persons of legal age may conclude a contract. Participation of minors in our games is subject to the respective age limits and participation rules under section 5.1.

2.2 Online bookings

The presentation of our offers in the online shop does not yet constitute a binding contractual offer.

By submitting an order with obligation to pay, the customer makes a binding offer to conclude a contract. Before completing the order, the entered data can be reviewed and corrected.

The contract is concluded with the automatically sent booking or order confirmation from TIMEBREAK. With the booking confirmation, the booked time slot is bindingly reserved.

2.3 Individual offers and corporate bookings

Separate offers can be prepared for corporate events, group bookings and other individually agreed services.

These offers are non-binding unless expressly designated as binding.

For non-binding offers, the contract is concluded only through TIMEBREAK's express order confirmation. The customer's mere declaration of acceptance or order does not yet result in a contract in these cases.

The services and conditions agreed by both parties form part of the contract. Individual agreements take precedence over the general provisions of these Terms.

2.4 Vouchers

When purchasing a voucher, the customer receives a voucher code which can be used to pay for corresponding TIMEBREAK services within the applicable voucher conditions.

Vouchers are generally transferable unless expressly agreed otherwise for individual vouchers or promotions.

2.5 E-mail address and order information

The customer is responsible for providing a correct e-mail address when booking and for ensuring that our messages can be received.

The essential booking or order information and the applicable contractual terms are provided to the customer in text form after conclusion of the contract.

3. Prices and payment terms

3.1 Prices

All prices stated to consumers include statutory VAT.

The prices stated at the time of booking or individually agreed apply.

Current prices for our escape rooms can be found at www.timebreak-mg.de/preise.

3.2 Payment terms for online bookings

For online bookings of escape rooms and purchases of vouchers, the full booking or purchase price is due immediately upon ordering.

Payment is made via the payment methods offered during the booking process.

3.3 Payment terms for individual events

Separate payment terms may apply to bookings that are not made via our online shop but are individually agreed and manually created by TIMEBREAK. This applies in particular to corporate events, group bookings and individually agreed services.

These bookings are usually invoiced. Unless otherwise agreed, a deposit of 50 % of the agreed total price is payable.

The remaining amount is to be paid on site on the day of the event or, if payment by invoice has been agreed, transferred within seven calendar days of receipt of the final invoice.

Deviating payment arrangements remain possible.

3.4 Changes to the number of participants and additional services

If additional costs arise from a subsequent increase in the number of participants or from additional services, these will be charged according to the agreed prices.

Any credits due to a reduction in the number of participants are governed by section 6 of these Terms.

3.5 Deposits in case of cancellation

In the event of a cancellation, deposits already paid will be offset against the cancellation fees validly agreed under section 6 or the compensation owed.

If the compensation owed exceeds the deposit paid, the difference is payable after corresponding invoicing.

Any credit remaining after offsetting will be issued as a value voucher in accordance with the agreed cancellation conditions. Statutory refund claims remain unaffected.

3.6 Payment methods

TIMEBREAK accepts the payment methods offered in the respective booking or payment process. These may include credit card, debit card and PayPal in particular.

For individually agreed bookings, payment may also be made by invoice.

4. Right of withdrawal

4.1 Bookings with a fixed event date

Pursuant to section 312g (2) sentence 1 no. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for contracts concerning leisure activities booked for a specific date or period.

This applies in particular to bookings of escape rooms and other date-bound events at TIMEBREAK.

The voluntary cancellation and rebooking options under section 6 of these Terms remain unaffected.

4.2 Value vouchers and promotional vouchers

When purchasing value vouchers via our online shop, consumers generally have a statutory right of withdrawal of 14 days. This also applies to discounted pre-sale vouchers that are purchased without a fixed game date and can be redeemed at a later time.

Value vouchers issued as part of a voluntary cancellation under section 6 of these Terms do not constitute a new voucher purchase.

For discount codes, promotional vouchers and special promotions, the promotion conditions communicated before conclusion of the contract apply in addition. Statutory rights remain unaffected.

5. Booking conditions

5.1 Age limits and participation of minors

The age limits and participation rules stated in the respective game description apply to participation in our escape rooms and other leisure activities.

Depending on the game, children and young people may participate from the age of 12 without an adult companion. For younger participants or games with special age requirements, accompaniment by at least one adult may be required.

TIMEBREAK reserves the right to verify the age of participants by requesting a suitable identity document.

5.2 Refusal of entry and exclusion from the game

TIMEBREAK reserves the right to refuse persons entry to the game and event rooms or to exclude them from participation if, due to significant intoxication, drug use, aggressive, insulting, threatening or abusive behaviour, the safety of persons, proper game operations or TIMEBREAK's property is endangered or significantly impaired.

In the event of an exclusion justified by the behaviour of the person concerned, there is generally no entitlement to a refund of the ticket price. Statutory claims remain unaffected.

5.3 Punctuality and delays

Our escape rooms are events with fixed start times. The game rooms are specially prepared for each booking and reserved for the agreed period.

Participants are obliged to arrive on time for the booked slot.

In the event of late arrival, TIMEBREAK reserves the right to refuse entry if proper performance of the game is no longer possible due to the delay.

There is no entitlement to an extension or postponement of the booked game slot in this case. TIMEBREAK's entitlement to payment remains in place in this case.

Statutory claims remain unaffected.

5.4 Food and drinks

Bringing and consuming your own food and drinks is generally not permitted on TIMEBREAK's premises.

Exceptions require TIMEBREAK's prior consent. This applies in particular to individually agreed events and special catering requests.

5.5 Bringing items and animals

Bringing weapons, dangerous objects, fireworks, pyrotechnic items or other objects that could endanger the safety of participants or game operations is not permitted.

Bringing animals is generally not allowed.

Statutory access rights apply to legally recognised assistance dogs. Our escape rooms are not barrier-free and, due to their spatial conditions and the light, sound and scare effects used in some cases, are not fully suitable for bringing assistance dogs.

We ask guests with assistance dogs to contact us before booking if possible, so that we can discuss the conditions of the desired escape room and possible solutions together.

Statutory access rights remain unaffected.

5.6 Mobile phones and photo, video and audio recordings

The use of mobile phones and the making of photo, video and audio recordings inside the escape rooms is generally not permitted.

In justified exceptional cases, for example professional on-call duty, medical necessity or required availability for childcare, mobile phones may be carried after prior arrangement with TIMEBREAK.

In these cases, use is permitted solely for the purpose communicated beforehand. Any other use, in particular for photographing, filming, recording, researching or assisting in solving puzzles, is expressly prohibited.

The publication or distribution of recordings and confidential game content is not permitted without TIMEBREAK's express consent.

5.7 Violations of the game and house rules

In the event of serious or repeated violations of these General Terms and Conditions, the game rules or the instructions of our staff, TIMEBREAK reserves the right to exclude the persons concerned from the game, to end the event early or to issue a ban from the premises.

This applies in particular to intentional damage to furnishings, tampering with safety equipment, disregard of safety-related instructions or significant disruption of game operations.

In the event of an exclusion justified by the participants' behaviour, there is generally no entitlement to a refund of the game price. Statutory claims remain unaffected.

5.8 Health

Darkness, confined spaces, light and sound effects and scare moments may occur in our escape rooms.

Participants whose health could be affected by these conditions are asked to contact TIMEBREAK before booking or at the latest before the game starts in order to discuss possible restrictions and individual solutions.

6. Cancellations and rebookings

Since our escape room bookings are date-bound leisure services, there is generally no statutory right of withdrawal pursuant to section 312g (2) no. 9 BGB.

TIMEBREAK nevertheless grants its customers voluntary cancellation and rebooking options in accordance with the following conditions.

6.1 Cancellation and rebooking conditions for bookings of one or two escape rooms

Scope

The following conditions apply to bookings of one or two escape rooms.

Bookings of three or more escape rooms are subject to the separate conditions under section 6.2.

Cancellation and rebooking of escape rooms

The number of escape rooms booked is binding.

Booked rooms can be cancelled free of charge against issue of a value voucher or rebooked once free of charge to an available alternative date up to 72 hours before the start of the game.

The cancellation conditions apply again to the alternative date.

In the event of a timely cancellation, the booking amount already paid for the rooms concerned will be refunded in full as a value voucher.

In the event of a cancellation less than 72 hours before the start of the game, an amount equal to the respective two-person price will be retained per cancelled room. Any amount already paid beyond this will be refunded as a value voucher.

Changing the number of players

The number of players can be adjusted on site on the day of the game, regardless of the cancellation and rebooking deadline.

The number of escape rooms booked remains unchanged. At least the respective two-person price is payable for each room booked, even if individual rooms are no longer used due to a lower number of participants.

If the number of players is reduced, the price difference between the originally booked and the actually played rate, taking into account the number of rooms booked, will be refunded as a value voucher.

If in doubt, we recommend booking for a smaller number of players first. Additional players can be added on site within the permitted room capacity. The additional payment can be made by card or PayPal.

6.2 Cancellation and rebooking conditions for larger groups

Scope

The following conditions apply to bookings of three or more escape rooms.

The originally booked number of escape rooms is decisive for the application of the 14-day cancellation and rebooking period.

A subsequent reduction in the number of rooms booked does not shorten the cancellation period.

Cancellation and rebooking of booked rooms

The number of escape rooms booked is binding.

Cancellation free of charge against issue of a value voucher or a one-time free rebooking to an available alternative date is possible up to 14 days before the start of the event.

The cancellation conditions apply again to the alternative date.

In the event of a timely cancellation, the booking amount already paid will be refunded in full as a value voucher.

In the event of a cancellation less than 14 days before the start of the event, an amount equal to the respective two-person price will be retained per cancelled room. Any amount already paid beyond this will be refunded as a value voucher.

Changing the number of players

For bookings of three or more escape rooms, the number of players within the booked rooms can be adjusted on the day of the game, provided the permitted minimum and maximum number of players for the respective room is observed.

The number of rooms booked remains unchanged. At least the respective two-person price is payable for each escape room booked.

Any price difference arising beyond this will be refunded as a value voucher.

Cancellation and changes to catering services

The following catering conditions apply to corporate events and other individually agreed events for which catering services have been booked in addition.

Additionally booked catering services can be cancelled free of charge or adjusted with regard to the number of persons ordered up to 14 days before the start of the event.

For later cancellations or changes, the cancellation conditions expressly communicated and agreed for the respective catering offer before booking apply. These may vary depending on the catering provider and the type of services ordered.

If no separate cancellation conditions are agreed, in the event of a cancellation or reduction less than 14 days before the start of the event, the catering provider's costs actually incurred by TIMEBREAK as a result, which are necessary and unavoidable, must be reimbursed.

Cancellation compensation for the event and for additional catering services is calculated separately. The same damage is not charged twice.

Proof of lower damage

Insofar as the cancellation fees or retentions provided for in sections 6.1 and 6.2 are to be treated as liquidated damages, the customer is expressly permitted to prove that TIMEBREAK has suffered no damage or significantly lower damage.

6.3 Contact and deadlines

The time of receipt of the notification by TIMEBREAK is decisive for compliance with the respective deadline.

Statutory claims remain unaffected.

6.4 Special promotions

Deviating cancellation and rebooking conditions may apply to bookings made as part of special promotions and event campaigns.

These are expressly communicated before completion of the booking and form part of the respective promotion conditions.

Statutory claims remain unaffected.

7. Changes to services

7.1 TIMEBREAK reserves the right to make necessary changes to the games and events offered for technical, organisational or safety-related reasons.

Such changes are permissible provided they do not significantly impair the essential character and overall scope of the booked service and are reasonable for the customer.

Statutory claims in the event of significant deviations in performance remain unaffected.

7.2 Force majeure

If TIMEBREAK is unable to provide a booked service due to force majeure, the affected performance obligations lapse in accordance with the statutory provisions.

Amounts already paid for services not provided will be refunded. Further claims are governed by the statutory provisions and the liability provisions of these Terms.

8. Video and audio transmission during the games

To supervise participants, to assist in solving puzzles and to ensure safety, the game rooms are monitored by our staff using cameras and microphones during the game.

The live transmission of video and audio serves solely to conduct and supervise the game experience and to ensure the safety of participants.

9. Liability

9.1 TIMEBREAK's liability for personal injury

TIMEBREAK is liable without limitation for damages arising from injury to life, body or health resulting from an intentional or negligent breach of duty by TIMEBREAK, its legal representatives or vicarious agents.

9.2 Liability for intent and gross negligence

For other damages, TIMEBREAK is liable without limitation in cases of intent and gross negligence.

9.3 Liability for breach of essential contractual obligations

In cases of slight negligence, TIMEBREAK is liable for other damages only in the event of a breach of essential contractual obligations. In these cases, liability is limited to the typical, foreseeable damage.

Essential contractual obligations are those whose fulfilment is a prerequisite for the proper performance of the contract and on whose observance the customer may regularly rely.

9.4 Other liability

Otherwise, liability for other damages in cases of slight negligence is excluded.

9.5 Damage caused by participants

Participants must treat the premises, furnishings, technical equipment and game props with care and follow the instructions of the staff.

Statutory claims for damages may be asserted for culpably caused damage or exceptional soiling. This includes in particular necessary and reasonable repair, replacement and cleaning costs.

Normal signs of use and ordinary soiling resulting from the intended use of the rooms are excluded from this.

9.6 Damage caused by minor participants

For damage caused by minor participants, the statutory provisions on the responsibility of minors and the liability of persons with a duty of supervision apply.

9.7 Mandatory liability provisions

Liability under the German Product Liability Act and for fraudulently concealed defects or expressly assumed guarantees remains unaffected.

9.8 Liability of staff

Insofar as TIMEBREAK's liability is excluded or limited, this also applies to the personal liability of its governing bodies, employees and vicarious agents.

10. Vouchers and redemption conditions

10.1 Value vouchers

TIMEBREAK offers value vouchers that can be redeemed to pay for escape rooms and other correspondingly designated offers.

The vouchers are generally transferable and can be used within the applicable redemption conditions.

10.2 Validity period

Regular value vouchers are valid until the end of the third calendar year following the year of purchase.

The same validity period applies to value vouchers issued as part of a voluntary cancellation under section 6 of these Terms. For these, the validity period begins with the year of issue.

Statutory claims remain unaffected.

10.3 Redemption and remaining credit

Value vouchers can be used as a means of payment when booking.

If the booking price exceeds the voucher value, the difference must be paid using one of the payment methods offered.

In the event of partial redemption, the remaining credit is retained and can be used for further bookings within the validity period.

Cash payment of the voucher value or any remaining credit is excluded unless there is a statutory entitlement to payment.

Redemption of value vouchers for date bookings

When a value voucher is redeemed for the binding booking of a game slot, the redeemed voucher amount is credited as a means of payment against the booking price.

A separate reversal of the voucher redemption or payment of the voucher value used for the date booking is not provided for.

The cancellation and rebooking conditions under section 6 of these Terms apply to the booked event regardless of the payment method used.

Mandatory statutory withdrawal and refund claims remain unaffected.

10.4 Promotional and pre-sale vouchers

The validity period set out in section 10.2 generally applies to pre-sale and promotional vouchers purchased for a fee.

Special promotion and redemption conditions may apply to time-limited discount promotions, for example summer promotions or Black Friday. These are expressly communicated to the customer before conclusion of the purchase contract.

Statutory rights remain unaffected.

11. Set-off, right of retention and applicable law

11.1 Set-off

The customer may set off claims of TIMEBREAK against undisputed or legally established counterclaims. The right to set off counterclaims arising from the same contractual relationship remains unaffected.

11.2 Right of retention

The customer may assert a right of retention insofar as their counterclaim is based on the same contractual relationship.

11.3 Contract language and translations

The governing contract language is German. TIMEBREAK may provide translations of the General Terms and Conditions and other contractual information for international customers.

Foreign-language versions serve as translations of the German contractual terms. The German version is authoritative unless mandatory statutory provisions or expressly made individual agreements provide otherwise.

11.4 Applicable law

The contractual relationship between TIMEBREAK and the customer is governed by the law of the Federal Republic of Germany.

For consumers habitually resident in another state, the mandatory consumer protection provisions of the state of their habitual residence remain unaffected insofar as they apply under the statutory conflict-of-law rules.

The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

11.5 Place of jurisdiction (B2B)

If the customer is a merchant, a legal entity under public law or a special fund under public law, Mönchengladbach is the exclusive place of jurisdiction.

11.6 Consumer dispute resolution

TIMEBREAK is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
