General Terms and Conditions & Withdrawal Policy

1. Scope of Application

These General Terms and Conditions apply exclusively to all business relationships between Escape Room Industry Services UG (haftungsbeschränkt), Waldhausener Str. 31, 41061 Mönchengladbach (hereinafter: TIMEBREAK) and the customer. Any deviating terms and conditions of the customer shall not become part of the contract, even if TIMEBREAK does not expressly object to them and even where we render performance.

2. Offers, Order Process, Contract Formation, Correction of Input Errors, Storage of the Contract Text

2.1 Tickets and vouchers for TIMEBREAK can be purchased via our website www.timebreak-mg.de or during our opening hours at our premises. Only persons of legal age are authorised to make purchases.

2.2 The ticket and voucher offers in our online shop constitute a non-binding invitation to order tickets or vouchers for TIMEBREAK. By clicking the "Confirm Order" button, the customer submits a legally binding offer to purchase the tickets or vouchers in the shopping cart. Before submitting the order, the customer can view and amend the entered data at any time. Required fields are marked with an asterisk (*). The message automatically generated by us after the order is submitted documents that your booking has been received by us, but does not yet constitute acceptance of the customer's offer. The contract is only formed upon our declaration of acceptance, which is sent in a separate, further email (booking confirmation). With the booking confirmation, the customer receives the tickets granting admission to the booked game. If the customer has ordered a voucher, the booking confirmation email will contain the voucher code, which entitles the customer – or the person to whom the customer passes on the voucher – to use the voucher amount as a means of payment when purchasing tickets.

2.3 The customer must ensure that the email address provided for order processing is correct and appropriately configured (for example, with regard to spam filters) and has sufficient free storage space.

2.4 The customer can correct input errors at any time during the order process by clicking on the relevant form fields and amending them.

2.5 The information from the order process will be sent to the customer again in the email confirming the order.

3. Prices, Payment Terms

3.1 The prices stated in our online shop include statutory value-added tax.

3.2 Payment for tickets and vouchers ordered in our online shop can be made by credit card (VISA and Mastercard), instant bank transfer, PayPal, Giropay, or on site in cash, by EC card or by credit card. We reserve the right to accept additional payment methods and to reject individual payment methods on a case-by-case basis.

4. Right of Withdrawal

4.1 Pursuant to § 312g para. 2 sentence 1 no. 9 BGB, there is no right of withdrawal for contracts for the provision of services related to leisure activities if the contract provides for a specific date or period of performance. The purchase of tickets for games at TIMEBREAK can therefore not be withdrawn by the customer.

4.2 In all other respects, the following applies: if the customer is a natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (consumer), the customer has a right of withdrawal pursuant to § 312g in conjunction with § 355 BGB. With regard to the requirements and legal consequences of the right of withdrawal, please refer to the withdrawal instructions in the appendix.

5. Booking Conditions

5.1 TIMEBREAK is a team game for people aged 12 to 99. From the age of 14, young people count as full-paying players and may play the rooms without an adult accompanying them. Children aged 9 to 14 may take part in the experience together with adults, provided the maximum number of participants is not exceeded. If a game is not suitable for children, this is stated in the room's description.

5.2 TIMEBREAK is entitled to refuse visitors access to the game rooms if there is reason to believe that the person or persons concerned may disrupt general business operations or harass other visitors as a result of alcohol or drug consumption or for other reasons. In such cases, no refund of the ticket price or voucher value will be given.

5.3 Please note that our games are live events. As the game rooms are specially prepared for each booking and reserved for the booked period, it is your responsibility to arrive on time for your booked slot. In the event of late arrival, TIMEBREAK reserves the right to refuse admission to the game in question. The ticket will lapse and there is no entitlement to a refund.

5.4 Bringing your own food and drinks is not permitted.

5.5 It is not permitted to bring bulky or dangerous objects, fireworks or other pyrotechnic articles, weapons and dangerous tools, spray cans, noise-making instruments, laser pointers, bottles, cans, intoxicants or animals – with the exception of animals required as assistance for a physical or mental disability.

5.6 Bringing mobile phones or image, film and audio recording devices into the game rooms is not permitted.

5.7 It is not permitted to make audio, image or film recordings during the games or of the premises, or to transmit or distribute such recordings, in whole or in part, via the internet or other media (including mobile networks).

5.8 Serious or repeated violations of the law or of these terms may result in expulsion from the TIMEBREAK premises without a refund of the ticket price or voucher value, as well as a ban from the premises.

6. Cancellations

6.1 Cancellation policy:

• You can cancel or rebook your booking free of charge more than 48 hours before the start of the game. To do so, simply send an email to hallo@timebreak-mg.de.
• For cancellations made between 48 and 24 hours before the start of the game, a cancellation fee of €50 will be charged.
• If you cancel less than 24 hours before the start of the game, a fee of €90 will be charged.
• If you have booked more than 1 room, the cancellation must be made at least 14 days before the start of the game. If this deadline is not met, a fee of €90 will be charged per booked room.
• These cancellation terms do not apply to bookings made as part of a promotional or event campaign (e.g. Black Friday / Black Weekend); in such cases, the cancellation terms stated on the promotion page apply.

7. Changes to Services

Deviations from and changes to the content of the games after booking will only be made where necessary, provided they are not significant and do not materially impair the overall content or character of the booked game.

8. Audio, Image and Film Recordings

8.1 TIMEBREAK is entitled to make audio, image and film recordings of the customer and their fellow players during the games where these are necessary for the running of the game.

9. Liability

In the event of impossibility and delay, as well as in the event of a breach of essential contractual obligations, we are also liable for slight negligence, although in that case liability is limited to the typical, foreseeable damage. Essential contractual obligations (cardinal obligations) are those contractual obligations whose fulfilment is a prerequisite for the proper performance of the contract in the first place and on whose observance the contracting party regularly relies and may rely. Typical, foreseeable damage is damage that falls within the protective purpose of the contractual provision breached in each case. In all other respects, we are not liable for slight negligence. The above limitations of liability also apply to our corporate bodies and vicarious agents.

10. Set-off, Contract Language

10.1 The customer is only entitled to set-off if their claim is undisputed or has been established by final judgment, unless the claim arises from the same contractual relationship. The customer is only entitled to a right of retention if their counterclaim is based on the same contractual relationship.

10.2 The contract is concluded in German. All disputes arising from the legal relationship between the customer and us are governed by the law of the Federal Republic of Germany. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
